Legal & Compliance Manager

Location: Albrighton


Primary purpose:

The Legal & Compliance Manager will lead a team of service providers whose remit is to safeguard the David Austin brand and the interests of the company. Aside from managing a small team of colleagues, the role will also encompass a growing audit programme which they will help to refine and implement.

This position will report to the Head of Licensing in the short-medium term, transferring to the Corporate Services Director in the medium-long term.


Your day to day:

  • Oversee and manage the Legal & Compliance Team with responsibility for ensuring the quality of the service they deliver, their goals are achieved, and deadlines are met.
  • Safeguard the David Austin brand by ensuring our company values are shared and respected by those we work with in all areas of the business and around the world, including but not limited to contractors, licensees, suppliers and partners.
  • Develop and maintain a Corporate Social Responsibility framework in conjunction with the Leadership Team and Head’s of Department.
  • Vett new partners and service providers against this framework.
  • Develop and implement an audit programme to assess and monitor ongoing compliance with the framework.
  • Monitor domestic and international markets, both through digital means and physical visits to review adherence to contractual obligations by our partners, and to identify any factors contributing to contamination of a market.
  • Create and implement a test purchase programme aimed at monitoring plant and service quality, delivered to both approved and suspected illegal sellers worldwide.
  • Report results of market monitoring and test purchasing to stakeholders for review and action.
  • Lead a programme to audit licensed and contract growers against their commercial contracts, to include field/crop audits, book/system audits and label stocks.

Legal Executive

Location: Albrighton


Primary purpose:

The role of the Legal Executive is to provide a support and advisory service to all teams across the business, on matters requiring legal or contractual input. Working as part of the Legal & Compliance Team, they will play an important role in safeguarding the David Austin brand.


Your day to day:

  • Identifying, qualifying and setting up business with appropriate legal partners across the world.
  • Liaising with legal representatives in various countries, seeking advice, reporting to stakeholders, and interpreting key points for consideration and risk factors.
  • Advising on content of, as well as drafting, amending and reviewing contracts with third parties, including but not limited to licence agreements, trademark agreements, copyright agreements, contract grower agreements, supplier trading agreements, engagement contracts for external commercial contractors, commercial terms and conditions, non-disclosure agreements, R&D contracts and employment contracts.
  • Preparation of evidence and files for enforcement matters; presenting facts, options, risks, and possible outcomes to assist in the decision-making process.
  • Actioning agreed plans for enforcement, including but not limited to sending letters of varying strength, working with lawyers to escalate proceedings, and attending the sites of suspected infringers, or those suspected of breaching contractual obligations, which may be outside of the UK, to support the audit team.
  • Debt recovery support.
  • Representing the company’s position with breeder organisations, trade organisations or other bodies whose work benefits the company as a whole.
  • Working closely with and supporting other members of the Legal & Compliance Team to achieve departmental goals, supporting on matters including but not limited
    to Intellectual Property, Competition Law, Contract law and Corporate Social Responsibility.
  • And such other duties and responsibilities as the Company may from time to time reasonably require you to carry out which may include work in other departments.

What you bring to the team:

  • Ability to demonstrate previous experience within a similar role and industry.
  • Able to demonstrate an understanding of the basic principles of contract law, competition law and intellectual property law, with practical examples.

Maintenance Supervisor

Location: Albrighton


Primary purpose:

The role of the maintenance Supervisor is to supervise, mentor and develop the Growing and Fulfilment maintenance team. Playing a key part in the day-to-day maintenance across the production sites to deliver an effective, efficient and high-quality maintenance process. As part of the wider DAR team this role will take on additional tasks and responsibilities (within the Supervisor’s capability) within other areas of the business.


Your day to day:

  • Supervise and lead the maintenance team to produce an agreed planned maintenance programme to make sure that DAR nurseries meet its own performance, legal, health and safety, compliance, and efficiency requirements.
  • Responsible for maintaining a healthy, safe and secure working environment, ensuring compliance with legal and regulatory requirements and maintaining accurate documentation.
  • Resolving maintenance issues where possible and reporting where necessary in a timely manner.
  • To report any areas that are health and safety or machine risk immediately, and make sure that as and when appropriate these areas are isolated / turned off, highlighted, barrier off as required.
  • To liaise with the rest of the management team to deliver the planned maintenance programme on time, on budget and in a way that minimises disruption.
  • To deliver the planned maintenance programme safely and effectively identifying during the maintenance cycle areas of investment or future repairs that need to be carried out.
  • To produce and maintain an agreed parts stores plan and stock level.
  • To effectively prioritise workload and liaise with management team to make sure resource is available when required.
  • To be responsive to breakdowns and to identify the cause and implement a process so that learning from breakdowns can be used to minimise breakdowns in the future. This will require turnout on 7 days a week at key times of year.
  • To identify and highlight areas of improvement and training required either for the maintenance team or for members of the work force using equipment / machinery
  • To produce and ensure that the team maintain a record of maintenance.
  • Responsible and accountable for the tasking, monitoring and management of external maintenance contractors.
  • Responsible and accountable for the delivery of key projects as identified by the business.
  • Responsible and accountable for tools / equipment and consumables purchase and management.

What you bring to the team:

  • Experienced fitter and/or in general business maintenance preferably with horticultural / agricultural experience, happy working on the nursery/in the field/in the office and turning hand to most things, indoors and out.
  • Already holding qualifications to service and repair, kerosene boilers / heaters commercial or be willing to train and take qualifications.
  • Able to work at height eg for the repair of broken glass or thermal screens.
  • Effective, accurate and honest communicator up and down and across all departments.
  • Well organised with excellent attention to detail and the ability to prioritise work.
  • Flexible approach to work and able to demonstrate problem solving skills.
  • A great team player and be able to motivate, mentor, train, support and develop their teams.
  • Able to work under time pressure.

Fulfilment Supervisor

Location: Albrighton

Primary purpose:

  • Daily operational responsibility of the fulfilment operation, leading managing and developing the fulfilment teams.
  • To ensure the delivery of departmental performance targets for DAR by Leading Managing, Training and Mentoring that team so that they continually work to a continuous improvement cycle delivering outstanding quality and customer service whilst working in an efficient and effective way, following business policies and SOP.
  • Responsible and accountable for the daily quality processed and delivered to our customers , monitoring , continuous improvement and daily reporting to meet the companies Quality KPI.
  • Required to deputise for the immediate line manager (this would include shift patterns), or during high workload times of year.
  • To provide support in specific key areas of the business as directed by the line manager.
  • To be responsible and accountable for key business goals and targets that may be assigned from time to time as and when required by the business.
  • To continually look at and suggest how the business can increase its effectiveness, efficiency, quality and customer service in the areas of the business being presently worked in at the time.
  • To work with the teams to Develop and Implement New Processes, Technology and IT Systems to Improve the Fulfilment Function.

Your day to day:

  • Responsible for the delivery of customer expectations in terms of quality, compliance to specifications, order accuracy and load-times.
  • Responsible for the monitoring of daily productivity and standards, addressing failures in a timely manner and identifying system improvements.
  • Responsible for ensuring that the Fulfilment unit has sufficient competent staff at all times through participation in the recruiting and selecting of applicants, effective labour planning and ensuring the effective introduction and training of new colleagues and the in-service development and training of colleagues to ensure a robust and sustainable team, with the skills, experience and knowledge required by the business.
  • Responsible for daily compliance with policies and procedures designed to meet business accreditation standards by ensuring that all records are completed, maintained and accurately filed, along with the training, mentoring and management of colleagues so that this standard is consistently and reliably maintained throughout the department.
  • Responsible for maintaining a healthy, safe and secure working environment, ensuring compliance with legal and regulatory requirements and maintaining accurate documentation. Resolving issues where possible and reporting where necessary in a timely manner.
  • Responsible and accountable for the planning, monitoring, and appraisal of fulfilment colleagues (which the supervisor has line management responsibility for) job performance; providing training, feedback, coaching and mentoring as required.
  • To manage absenteeism of staff line managed by the fulfilment supervisor and the onboarding of new Staff.
  • Attend meetings and / or deputise for the fulfilment and planning manager as required.
  • Responsible and accountable for implementation, review training and ensuring compliance with all DAR policies relating to staff, SOP and Health and Safety.

The Person:

  • Must be an effective, accurate and honest communicator up and down, both within and across departments.
  • Ideally have experience of working with the horticultural industry.
  • Ideally have experience or capability of leading, motivating and developing teams preferably at supervisory but would accept team leader level.
  • Should be at ease on the shop floor.
  • Ability to work under time pressure.
  • Ability to question own work in order to search out answers.
  • Willing and able to take an active part in research projects as required and as directed by the company.
  • Take active taking part in Inservice training.
  • Ideally have some experience of change management.
  • Must be well organised with excellent attention to detail and the ability to prioritise work.
  • Must have a flexible approach to work and able to demonstrate problem solving skills.
  • Ideally be proficient in the use of IT systems, including, but not limited to Microsoft Excel. Full training would be given as required.
  • Capable of deputising for line manager
  • Ideally have an understanding of process improvement and LEAN or similar thinking. Training would be given.
  • Ideally have a working knowledge of quality systems.
  • Must enjoy working with in a team and be able to motivate, mentor, train, support and develop their teams.
  • Should have a record of continual personal improvement.
  • Must have full UK (or equivalent) driving Licence.

          The position may involve early morning, late night and weekend working on a rota basis during the season and may involve the use of an annualised hours contract.

Gardens Supervisor

Location: Albrighton

Primary purpose:

Supervising and leading a small multi-disciplinary team who work within the Gardens at David Austin Roses and on other sites within a reasonable travel distance. To plan, organise and deliver a well thought through plan to keep the Gardens well maintained and looking at their very best.

To help deliver high standard roses to show standard in and out of season. for commercial shows or press events.

This is a hands-on get stuck in role.

This role plays a key part within the daily management of the growing and fulfilment teams and involves working closely with the supervisory and management team and requires a self-motivation, planning ,drive and the proven ability to help support, develop and mentor a small close knit team.

The Role:

  • To be responsible and accountable for the DAR gardens and show rose collection and as required to cover other areas of the business within your capability.
  • Using good horticultural knowledge and experience maintain the display gardens and other gardens, as directed, to a consistently high standard and as directed by the business and as environmentally sensitively as possible.
  • To fully understand the importance of being able to work in an open garden productively, whilst also being able to offer advice to the gardens visitors – when asked.
  • Leading, Managing, Training and Mentoring the gardens team so that it is effective, efficient, well trained supported and motivated so that it achieves the goals set following business policies and standard operating procedures.
  • Working with the commercial team on improvements to the garden design as required.
  • To provide support in specific key areas of the business as directed by the line manager
  • To be responsible and accountable for key business goals and targets that may be assigned from time to time as and when required by the business.
  • To continually look at and suggest how the business can increase its effectiveness in the areas of the business being presently worked on at the time.

Main Responsibilities:

  • Lead direct, train, manage , support , mentor the gardening
  • Accountable and Responsible for the team under your direct supervision achieving the required quality and work rates to ensure that the gardens are maintained to a high standard at all times whilst achieving productivity, environmental and cost related targets.
  • Accountable and Responsible for ensuring that the Garden is managed and maintained to the high standards agreed by the business.
  • Responsible for ensuring that the gardens team are trained and supported to be able to competently answer questions from members of the public who visit the gardens.
  • Accountable for ensuring that teams comply with all policies, Health and Safety procedures and any company or customer audit requirements.
  • To communicate efficiently and effectively with managers, other supervisors and team leaders and advisers, as required, to ensure that the gardens are kept looking at their best and managed in a way that achieves the high standard of plant and soil care that is required for plants to grow and perform at their best.
  • To ensure that the members of the team are trained, mentored and managed to maintain a standard agreed by the company that allows them to perform their job efficiently and effectively at all times.
  • Responsible for delivering a continuous improvement culture within the team and proactively working with other teams and departments across the business, to make sure that this culture of continuous improvement is maintained in a sustainable and continuous way across multi-disciplinary teams and other business departments, contributing to a culture of continuous improvement across the whole business.
  • Responsible, as directed, for the inspection and maintenance of equipment used in operational functions.
  • To be part of duty rotas.
  • To be part of the gardens and commercial team that helps improve and develop the gardens so that they are reflective of the business goals and aspirations.
  • To carry out any other duties within the company that may be reasonably requested of the Supervisor.

  • Identifying those within your teams that need more training, mentoring and support and delivering this as required and/or advising your immediate supervisor of this need.

The Person:

  • Must be an effective, accurate and honest communicator up and down, both within and across departments
  • Needs to be familiar with plants grown ideally and working in other gardens.
  • Ideally have experience or capability of leading, motivating and developing teams preferably at supervisory but would accept team leader level
  • Ability to work under time pressure
  • Ability and experience in planning gardening work loads.

  • Ideally experience of bio control
  • Must be able to lead and manage a team of cultural staff effectively and to achieve goals.
  • Ideally have a formal horticultural qualification, but other similar qualifications / experience would be considered. Or the company is happy to offer full training and support to the right candidate.
  • Good pest / disease / fertiliser knowledge and/or ability and willingness to learn,

Senior Team Leader - Fulfilment

Location: Albrighton

Primary purpose:

Supervising and leading small multi-disciplinary team(s) in arrange of work tasks on the growing, field and fulfilment sides of the business. These are hands-on get stuck in roles.

This role plays a key part within the daily management of the growing and fulfilment teams and involves working closely with the supervisory and management team and requires a self-motivation, planning and drive.

The Role:

  • To support, challenge and be accountable to the immediate line manager / supervisor, in achieving business goals, by leading small team(s) of people in the areas of Fulfilment, Container and Field production.
  • Leading, Managing, Training and Mentoring that team so that it is effective, efficient and achieves the goals set following business policies and standard operating procedures.
  • If required, to deputise for the immediate line manager /supervisor during their absence, (this would include shift patterns), or during high workload times of year. Also to stand in for other Senior Team Leaders when required.
  • Be able to deal with the day to day issues and problems raised by the team and Team Leaders with support.
  • To work with Manager/Supervisor to Manage Absenteeism (back to works)
  • To help implement onboarding of new staff into the business in the areas of Fulfilment, Container and Field for which you are responsible.
  • To be able to do some general administration (use of basic computer skills).
  • To provide support in specific key areas of the business as directed by the line manager / supervisor.
  • To be responsible and accountable for key business goals and targets that may be assigned from time to time as and when required by the business.
  • To be responsible and accountable for a key production process in the areas of Fulfilment (wholesale, retail bareroot and pots through post, Garden and Home) and Container ( grading, potting, bed work, P&D) and Field (field based tasks, such as lifting, budding, planting, watering ) and to cover other areas of the business where appropriate.
  • To continually look at and suggest how the business can increase its effectiveness in the areas of the business being presently worked in at the time.

Main Responsibilities:

  • Lead direct, train, manage , support , mentor the process(s) that the Senior team leader is directed to team lead .
  • Accountable and Responsible for the teams under your direct supervision achieving the required work rates to ensure productivity and cost related targets are achieved.
  • Accountable and Responsible for ensuring that the standards of product quality, specification compliance as set by the customer and the business are achieved.

  • To ensure that the members of the team are trained, mentored and managed to maintain a standard agreed by the company that allows them to perform their job efficiently and effectively at all times.
